The Difference Between Total and Residual Disability

When youre comparing different options for disability insurance, be on the lookout for the areas where policies are likely to differ. Dont assume that terms are defined in the same way from one policy to another. Pay close attention to the exact manner in which key policy terms, such as total disability and residual disability are described. Thats the only way you can be certain that you truly understand the terms and conditions of each policy option.

  • Total Disability: Some policies use an own occupation definition of total disability, while others use an any occupation definition.

Texas Homeowners Insurance

When looking for insurance in Texas it can prove expensive because of the risk of flood damage. As normal household insurance does not cover flood damage you will have to get special coverage. This can be done through the National Flood Insurance Program.

Hurricane issues also affect Texas and it can be difficult to get insurance against wind damage too. This is why the Texas Windstorm Insurance Association works to provide coverage for this. You Do not need to go to the TWIA to get this form of coverage though as your normal insurance company can provide this type of cover itself.

Florida Court Draws a Hard Line on Attorney’s Fees from FIGA

The Florida Insurance Guaranty Association (FIGA) is Florida’s public entity for resolving claims for certain insolvent insurers. FIGA is controlled mostly by statute, and attorney’s fees are no exception. Generally, under Florida Statute § 627.428, attorney’s fees are available for an insured who succeeds on legal action against his or her insurance company. However, Florida Statute § 631.70 exempts FIGA from § 627.428 unless FIGA, “denies by affirmative action, other than delay, a covered claim or a portion thereof.”
